You agree to indemnify, defend, and hold harmless InnTouch Travel and the Providers, its and their officers, directors, employees, affiliates, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorney’s fees, resulting from any violation by you of these Terms.

These Terms are for the benefit of InnTouch Travel and its Providers, its and their officers, directors, employees, affiliates, agents, licensors, and suppliers. Each of these individuals or entities shall have the right to assert and enforce these Terms directly against you on its or their own behalf.

 

Jurisdictional Matters

Unless otherwise specified, the content contained in this Website is presented solely for your convenience and/or information. This Website is controlled and operated by InnTouch Travel. InnTouch Travel makes no representation that content in this Website is appropriate or available for use in other locations. Those who choose to access the Website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. You may not use or export the materials on this Website in violation of federal or state laws and regulations. These Terms shall be governed by, construed and enforced in accordance with the laws of the State of Utah, as they are applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or InnTouch brings to enforce these Terms, or in connection with any matters related to this Website, shall be brought only in either the state or Federal courts located in Utah, and you expressly consent to the jurisdiction of said courts. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

 

Additional Terms

Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this Website, and you agree to abide by all other applicable terms and conditions including, but not limited to, paying all amounts owed on a timely basis and complying with all rules and restrictions regarding availability of products, programs, or services. We are only responsible for written representations that we make on this Website and are not responsible for any representations made by any other person or entity. Information about resorts and other accommodations available hereunder is based on information obtained from such resorts and/or providers of such accommodations. We expressly disclaim liability for inaccurate, incomplete, or misleading information concerning any resort or provider of accommodations. Confirmations issued hereunder are valid only if issued by us. Upon receipt, please check all the details in the Confirmation and notify us immediately if anything is incorrect, as changes to any aspect of the Confirmation may be treated as a cancellation. Any complaints about the accommodations or services provided at a resort should be made at the earliest opportunity to a person in authority at the resort and to us. A Confirmation may not be used for any commercial purpose, including rental or sale of the accommodation(s) which is/are represented by such Confirmation. A Confirmation may only be used by the person whose name(s) appears on the Confirmation. We reserve the right to cancel your Confirmation if payment for any accommodation(s) is/are rejected by your bank or credit card company. In the event the resort or other accommodation becomes inhabitable due to a natural disaster, we will not be liable for any resulting cancellations and no refund of any amounts paid by you will be made. If the accommodations which you confirmed become unavailable due to natural disaster, act of God, civil unrest or any other reason beyond our control, you waive any and all claims against us. We will have no liability to you for any loss, injury or damage which may occur while you stay at resort or other accommodation confirmed by you through InnTouch Travel or as a result of a third party. Our liability for any loss, injury or damage incurred by you as a result of any action or failure to act on our part, will be limited to consideration paid by you for the accommodation provided by or through InnTouch Travel, and in no event will we be liable for special, consequential or punitive damages. This limitation of liability shall also apply to all affiliated companies, servants and agents of InnTouch Travel. These Terms and Conditions constitute the entire agreement between you and us with respect to this Website and your use of this Website. As such, these Terms and Conditions (as modified by us, from time to time) will be deemed to supersede any prior or future communications, whether electronic, oral or written, between us. A printed version of these Terms and Conditions given in electronic form shall be admissible in judicial or administrative proceedings to the same extent, and subject to, the same conditions as other business documents and records originally generated and maintained in printed form. All accommodations confirmed are on an “As Is And with All Faults” basis. We hereby expressly disclaim all warranties relating to any accommodations purchased hereunder, express or implied, statutory or otherwise, including, without limitation, any and all warranties of merchantability or fitness for a particular purpose.

 

Disclaimer of Warranties and Liability

Account

The account you create on our Service also allows you to access other sites, apps, tools, and services offered by members of our Group of Companies (including Gusto Getaways, Peridot Vacations, Starlight, Gusto Exchange, and InnTouch Exchange), using the same account credentials, in addition to our Service (an “InnTouch Group Account”). Please note that when using your InnTouch Group Account, the relevant Terms and Conditions displayed on the sites, apps, tools, and services that you are using will govern the use of them.

Redirection and Third-Party Booking Services

If you are redirected from our Service to a third-party booking service (such as for hotel rentals) to make a travel booking, please bear in mind that any bookings made through such a booking service will be with the third-party and not with us. We are not responsible for bookings made through third party booking services and we have no liability to you in respect of such booking. The terms and conditions of the third-party service provider will set out what rights you have against them and will explain their liability to you.

 

Price and Payment

Full payment is required at the time of booking. Payable by Visa, MasterCard, American Express, Discover, and PayPal. All credit card charges will appear as InnTouch Travel. All prices are in US Dollars and are inclusive of the accommodation only.

Several Mexican resorts offer all-inclusive plans. An all-inclusive rate includes meals, beverages, and may include activities. All-inclusive plans do vary and fees are collected by the resort at check-in, so please check the specific resort for details.

You are responsible for payment of any applicable taxes, gratuities, personal expenses, utility charges, security deposits, and other fees or charges levied by a resort and/or provider of accommodations for the use of amenities and facilities.

 

Room Assignments and Occupancy

Room assignments are based on resort availability and are made at the resort’s discretion. Special requests such as room location, adjoining rooms, cribs, roll-a-way-beds, and handicap accessible rooms must be requested directly with the resort. Many of the resorts are older facilities and as such considered an “existing facility” under the Americans with Disabilities Act with neither guest rooms nor public spaces providing accommodations that meet current accessibility standards. Please refer to the individual resort website for resort-specific accessibility information.

The total number of people occupying any accommodation(s) must not exceed the maximum occupancy of the accommodation(s) set forth in the Confirmation; otherwise, access may be refused or the applicable resort or provider of the accommodations may levy an additional charge.

You and your guests must occupy and use any accommodations in a responsible, careful, and secure manner. You are responsible for any acts and omissions which result in any damage, theft or loss caused by you or your guests while using the accommodations.

We reserve the right to substitute accommodation due to circumstances that are beyond our control. Room photographs and maps are for information purposes only and may not accurately represent the property or specific room type selected.

 

Check-in Restrictions

Check-in restrictions, including age restrictions, may apply (for example, most resorts require Guests to be 21 years of age or older to check-in).

• Personal Information and Credit Card: A major credit card and photo identification will be required to check-in at your host resort. A refundable incidental hold may be placed on your payment method at check-in, as well as any other applicable charges.

• Late Arrival and Early Departure: If you are going to be delayed on your date of check-in or find that you cannot check-in to your accommodation on your scheduled check-in date, you must contact the resort to let them know. If you fail to check-in on the day of your reservation and do not notify the resort, the remaining portion of your reservation may be cancelled and considered a no-show reservation. No refund is provided for late arrival or early departure.

Rentals Cancellation Policy

• Vacation Weeks: Cancellation Policy for Vacation Weeks vary by resort. Please read the Reservation Policies section of the booking page when confirming your reservation. You may also find this policy in your booking payment receipt. Please note that some cancellations may entirely forfeit previous amounts paid.

• Hot Weeks: All Hot Weeks reservations are final and non-refundable.

• Hot Nights: All Hot Nights reservations are final and non-refundable.

Exchange Cancellation Policy

Exchange reservations may be cancelled, however, all Exchange fees, Upgrade fees, and Guest Name Change fees are non-refundable.

• Customers must call and speak with an InnTouch Travel Specialist at 1-800-405-5385 at least 48 hours prior to the scheduled check-in date.

• A $200 cancellation fee will be charged for any cancellation made within 48 hours of the scheduled check-in date.

• Upon cancellation of the exchange, the deposited week used for the exchange will be returned to the customer’s account, with the original expiration date, to be used for another exchange and by paying a new exchange fee.
